Online Complaints:

• Some states and cities have online platforms where you can file complaints. Check if your local police department has an online complaint system and submit your complaint through that channel.

Request the Reasons for Refusal:

• Politely ask the police officer for the reasons behind their refusal to file the complaint. Understanding their perspective can help address any concerns they may have.

Contact the Police Control Room:

• You can contact the Police Control Room at 111 and explain the situation. They may provide guidance or intervene in appropriate cases.

Speak to a Higher Officer:

• If the police officer at the station refuses to register the complaint, you have the right to approach a higher-ranking officer.

Submit a Written Application:

• If your verbal request is not successful, submit a written application to the SHO or higher-ranking officer detailing the incident and explaining why you believe a complaint should be filed.

  • In case the victim resides in metro city, mark a copy of your complaint to the Deputy Commissioner of Police / Commissioner of Police.

  • In case the victim resides in a non-metro city, mark a copy of your complaint to the Superintendent of Police.

  • If the offense committed is against a child, mark a copy of your complaint to National/State Commission for protection of Child Rights

  • If the offense committed is against a female child, mark a copy of complaint to National/State Commission for Women

  • If the offense committed is against a person of backward class, mark a copy of complaint to National/State Commission for backward classes

  • If the offense committed is against a person of minority communities, mark a copy of complaint to National/State Commission for Minorities

  • If the offense committed is against a person of SC/ST Community, mark a copy of complaint to National/State Commission for SC/ST Community

  • If need be, also mark a copy of complaint to the Chief Justice of the concerned High Court or the Supreme Court of India to make your complaint registered.

Contact the Magistrate:

• In case the higher-ranking officers also do not register your complaint, you can approach the Magistrate or the Judicial Magistrate directly. Submit a written application explaining the situation.

File a Private Complaint:

• If the police still do not register the complaint, you can file a private complaint directly with the Judicial Magistrate u/s 156(3) r/w s 200 of Cr.P.C. Seek legal advice to understand the procedure for filing a private complaint.

  • यदि पीड़ित गैर-मेट्रो शहर में रहता है, तो अपनी शिकायत की एक प्रति पुलिस अधीक्षक को भेजें।

  • यदि किया गया अपराध किसी बच्चे के खिलाफ है, तो अपनी शिकायत की एक प्रति राष्ट्रीय/राज्य बाल अधिकार संरक्षण आयोग को भेजें

  • यदि किया गया अपराध किसी बालिका के विरुद्ध है, तो शिकायत की एक प्रति राष्ट्रीय/राज्य महिला आयोग को भेजें

  • यदि किया गया अपराध पिछड़े वर्ग के व्यक्ति के विरुद्ध है, तो शिकायत की एक प्रति राष्ट्रीय/राज्य पिछड़ा वर्ग आयोग को भेजें

  • यदि किया गया अपराध अल्पसंख्यक समुदाय के किसी व्यक्ति के खिलाफ है, तो शिकायत की एक प्रति राष्ट्रीय/राज्य अल्पसंख्यक आयोग को भेजें

  • यदि किया गया अपराध एससी/एसटी समुदाय के किसी व्यक्ति के खिलाफ है, तो शिकायत की एक प्रति राष्ट्रीय/राज्य एससी/एसटी समुदाय आयोग को भेजें।

  • यदि आवश्यक हो, तो अपनी शिकायत दर्ज कराने के लिए शिकायत की एक प्रति संबंधित उच्च न्यायालय या भारत के सर्वोच्च न्यायालय के मुख्य न्यायाधीश को भी भेजें।

मजिस्ट्रेट से संपर्क करें:

• यदि उच्च पदस्थ अधिकारी भी आपकी शिकायत दर्ज नहीं करते हैं, तो आप सीधे मजिस्ट्रेट या न्यायिक मजिस्ट्रेट से संपर्क कर सकते हैं। स्थिति स्पष्ट करते हुए एक लिखित आवेदन जमा करें।
